WBP PRIVACY POLICY – AUSTRALIAN PRIVACY PRINCIPLES (APP)

POLICY OVERVIEW
WBP Group Pty Ltd and its associated entities (WBP) recognise the importance of protecting your privacy and are committed to compliance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles. This policy has been adopted as part of our commitment. This document sets out how WBP will handle personal information, including an overview of the types of personal information generally retained, and how personal information is collected, used, disclosed and stored.  

WHAT PERSONAL INFORMATION IS COLLECTED
WBP may collect or otherwise retain personal information during the ordinary course of conducting valuation, advisory or any other business.  

Subject to certain exemptions, personal information is defined in the Privacy Act as any information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.  

Generally, the types of personal information collected or otherwise retained by WBP may include but is not necessarily limited to names, contact details, addresses, telephone numbers, and information contained within documentation such as contracts of sale, certificates of title, planning or building documentation, and other records required to conduct business. 

SENSITIVE INFORMATION
Sensitive information is defined in the Privacy Act to include information or opinions about racial or ethnic origin, political opinions or membership, religious beliefs or affiliations, philosophical beliefs, professional or trade association membership, trade union membership, sexual orientation or practices, criminal record that is also personal information, health and genetic information and biometric information or templates. WBP do not ordinarily collect this category of information unless legitimately required. Where required, sensitive information will be used only for the primary purpose for which it was obtained, a directly related secondary purpose, with consent, or where required or authorised by law. 

HOW IS INFORMATION COLLECTED
Personal information may be collected directly from you or from third parties, including clients, lenders, legal representatives and public records, in connection with instructions provided to WBP or the conduct of ordinary business activities. 

HOW IS INFORMATION USED OR DISCLOSED
WBP generally collects, uses and discloses personal information for the purposes for which it was collected, for directly related purposes, to administer business operations, to provide valuation and advisory services, to comply with legal obligations, or where otherwise authorised by law.  

WBP uses thirdparty technology platforms and professional service providers, including but not limited to IT hosting providers, customer relationship management systems, accounting and payment systems, legal, banking, document management systems, workforce management systems, website analytics services, or platforms and backup systems. WBP may disclose your information for any of the above purposes to such third party providers.  

These providers may house or access personal information only as necessary to perform services for WBP and are required to protect personal information in a manner consistent with this Privacy Policy. 

It is not considered likely that WBP will disclose personal information to overseas recipients unless legitimately required in accordance with this Privacy Policy. 

DIRECT MARKETING AND SOCIAL MEDIA
Where information is collected directly from an individual and the individual would reasonably expect WBP to use that information for such purposes, WBP may use personal information for direct marketing and social media activities in accordance with the Privacy Act. WBP will provide individuals with a simple means to opt out of receiving marketing communications. Marketing and communication activities may be undertaken via email, digital communications and events. Thirdparty platforms may be used to support these activities. WBP does not sell personal information.  

STORAGE OF PERSONAL INFORMATION
Personal information collected by WBP is generally stored electronically. WBP will take reasonable and appropriate steps (including technology measures) to protect any personal information collected from misuse, interference, loss and unauthorised access or disclosure.  

RETENTION OF PERSONAL INFORMATION
Personal information is retained for as long as required by law or industry best practice. Due to the nature of WBP’s services, including valuations relied upon by lenders, courts and other parties, personal information may be retained for extended periods for legal, professional, regulatory and risk management purposes, including the establishment, exercise or defence of legal claims. 

WBP will take reasonable steps to destroy or permanently de-identify your personal information, once it is no longer required by WBP.  

CONSENT
By providing personal information, you consent for that information to be collected, used and disclosed in accordance with this policy. 

ANONYMITY
Where practicable and lawful, you may deal with WBP anonymously, using a pseudonym or otherwise request for your personal information to be deleted. However, this may limit the services WBP can provide. If you wish to make a request, you can email: [email protected] 

LINKS TO THIRD-PARTY WEBSITES
WBP is not responsible for the privacy practices of third-party websites. 

NOTIFIABLE DATA BREACHES SCHEME (NDB SCHEME)
WBP complies with the NDB Scheme and maintains a Data Breach Response Plan. All relevant personnel will be notified in the event of a breach where WBP is legally required to do so.   

COOKIES  

Cookies are small text files sent to your browser by a website you visit. They help that website remember information about your visit, which can both make it easier to visit the site again and make the site more useful to you.  

Third-party cookies may also be used on WBP’s website. WBP does not control the third parties, or their cookies and we refer you to the third parties’ websites for details as to how they use their cookies.  

Cookies are either (i) essential or (ii) non-essential. 

Essential cookies are necessary for WBP’s website to function effectively and to enable you to receive a service you have requested. All other cookies are non-essential, and may, in some cases, collect your personal information.  

You may configure your web browser to reject cookies. However, certain functions may become unavailable to you.  

If you access a third party website from our website, those websites are not subject to this Privacy Policy.  

GENERAL DATA PROTECTION REGULATION (GDPR)
GDPR covers personal data protection for individuals within the European Union and the European Economic Area. WBP primarily operates in Australia and has limited GDPR exposure. Where the GDPR applies, individuals may have additional rights including restriction of processing, data portability and the right to object to direct marketing, subject to applicable legal and retention obligations. Where applicable, GDPR obligations will be complied with. 

AMENDMENTS TO THIS PRIVACY POLICY 

WBP reserves the right to amend this Privacy Policy from time to time. A copy of WBP’s latest Privacy Privacy will be published on its website www.wbpgroup.com.au

Your identity will need to be verified by WBP. WBP may also charge a fee to cover the cost of retrieval and the supply of the information to you. Access will be provided to you within a reasonable time. A reason will be provided to you in the event we refuse your request.
